Major changes have hit the Section 111 reporting landscape – with all insurers in Medicare’s bull’s eye. CMS’s Section 111 penalties are finally live which can subject insurers to penalties of up to $1,474 per day, per claim.
From another angle, CMS’s new TPOC/WCMSA reporting requirements will, for the first time, give Medicare unprecedented visibility into WCMSA practices through the Section 111 reporting process – with CMS reserving all recourses to enforce compliance, including potential False Claims Act claims.

Mark Popolizio, J.D. is the Vice President of MSP Compliance for Verisk Casualty Solutions. He is a nationally recognized authority in Medicare Secondary Payer (MSP) compliance. Mark practiced insurance defense litigation for ten years concentrating in the areas of workers’ compensation and general liability. As of 2006, Mark has dedicated his practice exclusively to MSP compliance working with carriers, self-insureds, TPAs and other claims professionals in addressing MSP compliance issues. Since 2001, Mark has been a regularly featured presenter on MSP issues at national seminars and other industry events – and has authored numerous national articles addressing several topics related to MSP matters. In addition, Mark has released several articles on Third-Party Litigation Funding issues. Mark is also active with several industry groups. Mark is licensed to practice law in Florida and Connecticut.
Brian Cowan, J.D. is the Vice President of Services for Verisk Casualty Solutions. Brian oversees Verisk’s suit of automated conditional payment and MSA products including CP Link, MSA Link, and Data Driven MSAs as well as managing our strategic partnerships around professional administration. He also provides policy support to our Services team as well as working with clients developing protocols and building their MSP compliance program. Brian also provides trainings on a variety of MSP Compliance topics including Section 111, conditional payments, MSAs, and CMS submission. He worked in international development in Central Asia most recently serving as a Peace Corps volunteer in Kyrgyzstan, before beginning his legal career. Brian earned a BA in Religious Studies at Elizabethtown College; a MA in Ethics and Peace at American University; and his JD from New England School of Law.
